    We now have more details on proposed changes to the employee vs independent contractor test in Section 6 of the Employment Relations Act 2000, including an expectation that a Bill amending the Act will be introduced in 2025. The changes appear to be intently focused on Uber and similar gig economy services, so may not be as wide-reaching as first envisaged.     In this long-awaited decision, the Court of Appeal (CA) has affirmed the Employment Court’s 2022 decision, by finding that four Uber drivers were in fact employees and not independent contractors. The distinction between an employee and an independent contractor is an important one because employees are afforded significantly more protection than contractors. These protections include leave entitlements, the minimum wage, holiday pay, and the ability to bring a personal grievance.

    The director of a company and his wife, a manager, have been ordered by the Employment Relations Authority (Authority) to pay over $90,000 in reparations to an employee after the company breached minimum employment standards. Background:Mr Y was the sole director of BDIT, which went into liquidation at the end of 2020. The employee, Mr S, worked for the company under a work visa, which tied him to working only for BDIT in its restaurant businesses.

    Southern Highlands Veterans continue to play great golf. File picture. The Southern Highlands Veterans have played most of the local golf courses in recent weeks and continue to enjoy superb course conditions. The weather has been warming up as have the scores. Playing numbers have been slightly disappointing but this will hopefully pick up during the spring. On Thursday, August 24, players were at Moss Vale for a stableford event.
