Supreme Court Finds FCA Applies to E-Rate Reimbursement RequestsIn a unanimous decision, the Supreme Court ruled that telecommunications providers receiving E-Rate program distributions can be subject to civil liability under the False Claims Act (FCA) for obtaining excess payments in violation of the “lowest corresponding price rule.” This rule requires telecom providers to charge schools, districts, and libraries at levels that they would charge a “similarly situated” non-residential customer.

The Supreme Court in a 6-3 vote overturned the landmark decision in Chevron v. Natural Resources Defense Council, sharply limiting the authority of federal administrative agencies including the Federal Communications Commission (FCC). After the decision in Loper Bright Enterprises v. Raimondo, it will be easier to challenge and overturn agency decisions, and federal agencies will be more hesitant to adopt new regulations absent clear Congressional direction.

TracFone Settles Lifeline and EBB Investigation for $23.5 MillionLast week, TracFone Wireless (“TracFone”), a subsidiary of Verizon, settled Enforcement Bureau investigations into violations of the FCC’s Lifeline and Emergency Broadband Benefit (“EBB”) programs. TracFone self-identified and reported the potential violations and agreed to a $17,487,000 civil penalty and a $6,013,000 fine to resolve a 2020 Notice of Apparent Liability (“NAL”) for other Lifeline violations.
