On December 4, 2024, the U.S. Department of Labor (DOL) proposed ending the practice of paying subminimum wages to workers with certain disabilities. The proposed rule would phase out subminimum wages for workers with disabilities over a three-year period. The DOL recently proposed dropping the subminimum wage rule under federal law. Since 1938, federal law has allowed some employers to pay subminimum wages to workers with certain developmental, physical, and mental disabilities.

Quick HitsThe DOL has appealed a federal judge’s recent decision striking down its increases to the salary thresholds for the white-collar exemptions from the FLSA’s overtime requirements. The rule increased the minimum salary to $43,888 per year on July 1, 2024, and effective January 1, 2024, it would have increased the minimum salary to the equivalent of $58,656 per year for the EAP exemption and $151,164 per year for the HCE exemption.
