The Court of Appeal has given its judgment in the Virgin Media case. This
litigation concerns the validity of a rule amendment affecting
benefits in a DB contracted-out scheme which was made without
obtaining the actuary's written confirmation as required by
section 37 of the Pension Schemes Act 1993.
The question appealed was whether a confirmation was required
for changes to future service benefits or just past service
benefits.

The Government has laid before Parliament the final regulations concerning the funding and investment strategy requirements to be introduced by the Pension Schemes Act 2021 (the "Regulations"). The Regulations set out new principles that will govern how defined benefit (DB) schemes will have to be funded, alongside an integrated investment strategy, based on a long-term objective for providing benefits (for example buy-out, consolidation or run-off).

The Pensions Regulator (the "Regulator") has updated the questions for Defined Benefit ("DB") and Hybrid schemes to answer in this year's Scheme Return (which will need completing by 31 March 2024). The Pensions Regulator has published its General Code of Practice, setting out its expectations for good governance in occupational, personal and public service pension schemes. The Code has been laid before Parliament and is expected to take effect on 27 March 2024. What does the Code cover and how will it be applied? The Code consolidates and replaces 10 of the Regulator's 16 existing codes of practice into an updated, online version.
