The Government has laid before Parliament the final regulations concerning the funding and investment strategy requirements to be introduced by the Pension Schemes Act 2021 (the "Regulations"). The Regulations set out new principles that will govern how defined benefit (DB) schemes will have to be funded, alongside an integrated investment strategy, based on a long-term objective for providing benefits (for example buy-out, consolidation or run-off).

The Pensions Regulator (the "Regulator") has updated the questions for Defined Benefit ("DB") and Hybrid schemes to answer in this year's Scheme Return (which will need completing by 31 March 2024). As well as detailed additional questions about a scheme's leveraged liability driven investment ("LDI") arrangements, schemes must provide information about their fiduciary managers, investment consultancy providers and Additional Voluntary Contributions ("AVC") providers.

On 24 April 2023, The Pensions Regulator (TPR) and the
Financial Conduct Authority (FCA) each issued guidance for UK
defined benefit (DB) pension schemes and their managers on
Liability Driven Investment (LDI) strategies: TPR's guidance is
here, and the FCA's guidance is here.
The new TPR and FCA guidance follows the volatility crisis in
the UK gilts market in late September 2022 and the statements
issued at the time by the two regulators (see our previous
briefing).
