Broader, interconnected environmental issues include impacts on protected flora and fauna, waste and water management, contamination and amenity impacts on communities. These continue to be reputationally significant and highly visible across certain industries. Biodiversity is increasingly a central issue in ESG, as focus shifts to nature repair and addressing the alarming decline in flora and fauna.

Despite mounting pressure to accelerate cuts in greenhouse gas (GHG) emissions in line with Paris Agreements targets, progress developing rules governing global carbon markets to underpin such policies has remained slow at best. With carbon markets – trading systems where carbon credits are bought and sold to help companies compensate for GHG emissions – seen as a crucial tool to help nations hit climate commitments, COP28 represents an opportunity to provide the necessary regulatory clarity.

In October 2023, the Clean Energy Regulator released
guidelines to assist responsible emitters and auditors making
applications for an emissions-intensity determination. For existing
Safeguard Mechanism facilities, this determination will be an
important factor in how a facility's unique baseline will be
calculated under the reformed Safeguard Mechanism scheme.
Applications are due by 30 April 2024. This is the first
compliance deadline under the reformed regime for existing
facilities.

Snapshot Federal Minister for the Environment, Tanya Plibersek, has announced a comprehensive audit of more than 1,000 environmental offset sites. This audit aims to determine if project proponents have adhered to offset requirements and if the claimed environmental benefits have been realised. The Government has cautioned project proponents to ensure they are well-prepared and transparent about any issues prior to the commencement of reviews.

The Safeguard Mechanism (Crediting) Amendment Bill 2023 was passed by the Australian Parliament on 30 March 2023. The Bill was primarily introduced to enable the crediting element of the reform, however the changes negotiated with the Australian Greens Party are not limited to crediting and will extend beyond amendments to the Bill itself. We explore key aspects of the Bill and our current understanding of the other agreed amendments to the Safeguard Mechanism Reforms.
