In October 2023, the Clean Energy Regulator released
guidelines to assist responsible emitters and auditors making
applications for an emissions-intensity determination. For existing
Safeguard Mechanism facilities, this determination will be an
important factor in how a facility's unique baseline will be
calculated under the reformed Safeguard Mechanism scheme.
Applications are due by 30 April 2024. This is the first
compliance deadline under the reformed regime for existing
facilities.

State Environmental Planning Policy (Sustainable Buildings)
2022. This is expected to put sustainability at the forefront
of development and contribute to the delivery of a net zero economy
in NSW by 2050.

A statutory independent review of biodiversity laws in
NSW has identified the need for more clarity, a proactive approach
to address impacts, and a greater focus on impact avoidance and
minimisation instead of offsets.
An independent review panel (Panel) has found that the
Biodiversity Conservation Act 2016 (NSW) (BC Act) is not
meeting its primary purpose to maintain a healthy, productive and
resilient environment, and is never likely to do so.

Snapshot Federal Minister for the Environment, Tanya Plibersek, has announced a comprehensive audit of more than 1,000 environmental offset sites. This audit aims to determine if project proponents have adhered to offset requirements and if the claimed environmental benefits have been realised. The Government has cautioned project proponents to ensure they are well-prepared and transparent about any issues prior to the commencement of reviews.

The Safeguard Mechanism (Crediting) Amendment Bill 2023 was passed by the Australian Parliament on 30 March 2023. The Bill was primarily introduced to enable the crediting element of the reform, however the changes negotiated with the Australian Greens Party are not limited to crediting and will extend beyond amendments to the Bill itself. We explore key aspects of the Bill and our current understanding of the other agreed amendments to the Safeguard Mechanism Reforms.
