On June 5, the U.S. Supreme Court published a decision in Ames v. Ohio Dept. of Youth Servicesthat clarifies the burden of proof necessary in a "majoritygroup" discrimination claim under Title VII. Majority groupdiscrimination (or reverse discrimination) involves discriminationby a minority group against someone who is not in the minoritygroup. The decision in Ames resolves a circuit split withrespect to the applicability of the "backgroundcircumstances" rule and expressly rejects the rule.
