Following the release of a memo last month detailing upcoming regulations, the Massachusetts Board of Registration in Pharmacy released its long-awaited regulatory changes for non-resident pharmacy licensure last week by updating 247 CMR 6.00. As we previously advised, all out-of-state pharmacies shipping into Massachusetts are impacted by these updated regulations. Pharmacies should prepare to submit applications as soon as they are released in January, as the Board anticipates processing delays.

After almost a decade of waiting, Massachusetts has announced that it will open its licensing process for non-resident pharmacies. Yesterday, the Massachusetts Board of Registration in Pharmacy published a memo announcing that regulations related to the licensure of non-resident pharmacies will be promulgated in December 2024 and that the Board will begin accepting applications on January 1, 2025. The Board has established a grace period for applications through March 31, 2025.

The Drug Enforcement Administration (DEA) has announced a third temporary extension of the telemedicine flexibilities originally implemented during the COVID-19 Public Health Emergency (PHE). This third extension continues the current controlled substance telemedicine prescribing rules, which allow practitioners to prescribe controlled substances via telemedicine without requiring an in-person visit. The provisions will stay in effect through December 31, 2025.
