一、馳名商標の認定原則 （一）受動的保護原則 中国国家知識産権局商標局（以下商標局という）又は裁判所は、具体的な事件において、当事者の請求に応じて、その商標が馳名商標であるかを認定し、かつ事実認定をした上で、審決又は判決を出すことができます。当事者が馳名商標としての保護を主張していない場合、商標局又は裁判所は、自発的に認定しません。 （二）事件ごとの個別認定原則 まず、当事者は、具体的な事件において、係争商標が、既に関連公衆に熟知されている商標の複製、模倣、翻訳に該当し、かつ公衆に混同又は誤認を生じさせ、当事者の利益を侵害するおそれがあると考える場合においてのみ、馳名商標の認定を請求することができます。また、商標局又は裁判所は、当事者が提出した証拠に基づいて馳名商標の認定を行い、証拠や事件の状況によっては結論が異なる可能性があります。そして、馳名商標の認定の結果は当該事件についてのみ有効なものとなります。つまり、個別の事件において馳名商標として保護されることは、後続のすべての事件において馳名商標として保護されることができることを意味するものではありません。...
