To the Editor IHL regulates the special circumstances of armed conflict. It strikes a delicate balance between military and humanitarian imperatives by sanctioning lethal force against legitimate targets while seeking to mitigate the horrors of war.1 As a recent Viewpoint2 astutely noted, the protection of health facilities, medical personnel, and patients lies at the heart of the IHL framework and provided the impetus for the earliest efforts to codify the rules of warfare.

To the Editor A recent Viewpoint1 elucidated the potential of IHL in protecting the sacredness of health care. But, they also highlighted the difficulties in implementing its lofty principles. Throughout most modern wars, protection of the right to health embodied in these humanitarian principles2 has been violated, by targeting civilians and their living spaces.

The Supreme Court of Texas notched itself into a troubling tapestry of U.S. legal history when it overturned a district court ruling that would have allowed Kate Cox, a 31-year-old Texas woman, to end her nonviable pregnancy. District Court Judge Maya Guerra Gamble granted the exception based on copiously assembled facts offered in the case. She took seriously that Cox’s life would be in danger if the pregnancy advanced (it was already 20 weeks along).

International humanitarian law (IHL) governs armed conflict to protect civilians and limit methods of warfare. The origins of IHL have proven tragically prescient. The 1864 treaty that laid the foundation for IHL, addressing wounded soldiers, afforded ambulances and military hospitals protected status, while safeguarding medical personnel.1 Eighty years later, the Nuremburg Trials invoked the salience of medical ethics.

One hundred and fifty years ago, in Bradwell v. Illinois, the US Supreme Court affirmed an Illinois law barring women from becoming lawyers. According to the court, women were best suited to taking care of their husbands and children. Other states followed suit, also barring women from joining the legal profession. Only later, in Roe v. Wade, did the Supreme Court dispense with that sophistry when it ruled that unwanted motherhood could be economically, physically, and psychologically harmful.
