enforcement. Of particular interest to us has been the Supreme
Court's ruling on four cases relating to the arbitrability of
disputes in the last two years. In this update, we take a look back
on these recent rulings as the court seems to have embraced
resolving practical open issues in arbitration procedure.

In a unanimous decision (issued just a month after oral
argument), the United States Supreme Court held that when a court
grants a motion to compel arbitration, if a party asks for a stay
of the case, the court must stay the case, and
is not permitted to dismiss it, pursuant to Section 3 of the
FAA. Smith v. Spizzirri, 601 U. S. ____ (2024) (Slip
Op.).

When we last discussed the potential sale of the stock of Citgo
in Crystallex International Corporation v. Bolivarian Republic
of Venezuela, No. 17-mc-151, D. Del. (Crystallex), we
noted that briefing was ongoing in a New York Court of Appeals case
to determine the validity of the 2020 PDVSA bonds and the lien on a
majority of shares in Citgo. [See here].

The Supreme Court has granted certiorari in Smith v. Spizzirri, No. 22-1218 following the request from two Ninth
Circuit judges to weigh in on whether a district court must stay or
dismiss a suit after the court has granted a motion to compel
arbitration. See Forrest v. Spizzirri, 62 F.4th 1201 (9th
Cir. 2023).
