ACLU-NM is dedicated to safeguarding and promoting justice, freedom, and fairness as outlined in both the New Mexico and U.S. constitutions. Our mission is to turn the ideals of justice, freedom, and fairness into tangible realities for everyone in New Mexico, focusing especially on the rights of historically marginalized individuals and communities.

Our First Amendment rights do not disappear at the schoolhouse gates. Students of all ages can, and have, exercised their right to free speech, assembly, religion and expression since America’s founding. At the same time, schools can place reasonable restrictions on how students express themselves if their speech would be disruptive to the school environment or infringe on the rights of others.

Can a bakery that objects to marriage equality refuse to sell a cake to a gay couple for their wedding? This question, or some variant thereof, has occupied courts even before marriages for same-sex couples were legally recognized. In June 2023, in 303 Creative v. Elenis, the Supreme Court addressed this question in a case asking whether a wedding website design business could refuse to design websites for weddings of same-sex couples. The court ruled for the business.

As a born and raised New Mexican, I am sometimes obnoxiously proud of my home state. Any chance I get, I will gush to my friends from other parts of the country about what makes our state special. I’ll look for opportunities to drop into conversation that New Mexico is the only state in the country to have more than two UNESCO World Heritage Sites, or that we have the second-highest number of days of sunshine in a year, or that Santa Fe is the nation’s oldest state capital.
