Mass tort coordination could be on the horizon for a collection of Philadelphia lawsuits tying the injectable contraceptive drug Depo-Provera to brain tumors. Pfizer Inc., which manufactures the branded version of Depo-Provera, last week asked the Philadelphia Court of Common Pleas to coordinate litigation over the drug and its authorized generic equivalents into a mass tort.

Two new mass torts are taking shape in Philadelphia. Over the course of the past month, the Philadelphia Court of Common Pleas has been setting up coordinated proceedings for litigation over hair relaxer products and Johnson & Johnson talcum powder. Administrative Judge Daniel Anders of the Philadelphia Court of Common Pleas trial division created the two programs in a pair of April 30 orders, marking the first new additions to the court’s mass tort docket since 2022.

The Pennsylvania Superior Court on Tuesday upheld an $11.6 million medical malpractice judgment against the Children’s Hospital of Philadelphia over the fatally botched intubation of a 4-year-old boy. In a 37-page opinion, the three-judge panel rejected CHOP’s argument that it did not owe a legal duty to the boy. And as for CHOP’s remaining challenges to the verdict, the court held that the hospital had waived most of its other arguments.

The Pennsylvania Superior Court on Thursday declined to kick a Philadelphia law firm off of a collection of construction defect lawsuits, despite the firm’s improper procurement of confidential documents concerning the defendants. The three-judge panel ruled that Horn Williamson’s actions were “troubling,” but the misconduct could be remedied without going so far as to remove the firm from the litigation.
