The FCC issued a Notice of Apparent Liability for Forfeiture (“NAL”) to Vero Broadband, LLC (“Vero”) for failing to obtain the Commission’s prior approval before acquiring entities holding FCC Section 214 authorizations and wireless radio licenses. Domestic Section 214 carriers seeking to transfer control of their lines or authorization to operate must obtain prior approval from the Commission.

The FCC raised the Commission’s benchmark for high-speed fixed broadband to download speeds of 100 megabits per second and upload speeds of 20 megabits per second (“100/20 Mbps”). The most recent benchmark had been 25/3 Mbps, which was set in 2015. The new benchmark now reflects the standards being used in multiple Universal Service Fund programs and the National Telecommunications and Information Administration’s Broadband Equity Access and Deployment program.

Last week, a Petition for Rulemaking was filed by several industry players including the Enterprise Wireless Alliance and Anterix, Inc. requesting the FCC provide an option for 5/5 MHz broadband networks in the 900 MHz band. The proposed rule change is meant to support wide-area, private, and secure wireless broadband networks for business enterprise entities. The proposed rules would allow initial 5/5 MHz authorizations or the expansion of 3/3 MHz licenses upon application.

The FCC issued a reminder to telecommunications carriers and interconnected VoIP providers of the obligation to file an annual certification confirming compliance with the FCC’s Customer Proprietary Network Information (“CPNI”) rules by March 1, 2024. The CPNI rules require providers to protect CPNI from unauthorized access, use, or disclosure. Certification filings can be made in the Commission’s Electronic Comment Filing System (“ECFS”) or the FCC’s web-based application.

The D.C. Department of Employment Services (DOES) has issued a new Paid Family Leave notice/poster. This notice must be posted in a “conspicuous place”, such as where the employer posts employment-related information, and must be provided to employees, on or before February 1, 2024. The new notice, effective October, 2023, is identical to the previous notice, which was issued in October 2022, except that the maximum weekly benefit has increased. The new maximum weekly benefit is $1,118.
