On August 1, 2024, the Cybersecurity and Infrastructure Security Agency (CISA) announced the appointment of its first CISA Chief Artificial Intelligence Officer. The appointee, Lisa Einstein, served as CISA’s Senior Advisor for AI and as Executive Director of CISA’s Cybersecurity Advisory Committee, advising CISA on the reduction of risk to critical infrastructure. HealthEquity, an administrator of workplace benefits for more than 15 million people, is notifying 4.3 million individuals, starting on August 9, 2024, that their personal information was compromised. In an impactful decision that may limit the scope of future Securities and Exchange Commission (“SEC”) enforcement efforts against public companies over inadequate cyber controls, the U.S. District Court for the Southern District of New York recently dismissed significant portions of the SEC’s fraud and internal accounting controls case against software developer SolarWinds Corp. (“SolarWinds”). The lawsuit focused on a series of cyber-attacks against SolarWinds beginning in 2020.

Maryland recently became the fifth state in 2024—and the 17th U.S. state overall—to pass a comprehensive data privacy law. Effective October 1, 2025, the Maryland Online Data Privacy Act (“MODPA”) contains a number of unique provisions that govern the processing of sensitive and children’s data, among other things. These unique provisions, combined with the broad applicability of the law, makes MODPA one of the more operationally challenging privacy laws passed in the United States to date.

Australian authorities announced that the new Pacific engagement visa will open its first ballot on June 3. As BAL previously reported, Australian authorities introduced a new permanent resident visa program called the Pacific engagement visa for nationals of participating Pacific island countries and Timor-Leste. It will provide 3,000 permanent placement visas annually to Pacific island and Timor-Leste nationals and their immediate family members (partners and dependent children).
