Justice Anthony Kennedy famously occupied that role—casting pivotal votes on same-sex marriage, affirmative action, campaign finance, and capital punishment. His jurisprudence wasn’t always consistent, but it was often decisive. With his retirement, and the appointments of Justices Gorsuch, Kavanaugh, and Barrett, the Court adopted a solid 6–3 conservative majority.
