A Morgan County judge says he won't postpone Mac Bailey Marquette's upcoming immunity hearing and trial. Judge Charles Elliott issued that ruling Thursday. Marquette's lawyer requested that postponement last Friday, while he awaits a ruling from the Alabama Court of Criminal Appeals on his motion to have Elliott removed from the case.

In a section of that motion titled "The Shooting," Marquette says he was on patrol the morning of Sept. 29, 2023, when he got "called as back-up" to a towing company in Decatur.

Birmingham's Ruben Studdard earned the top title in 2003, Huntsville's Bo Bice was runner up to American Idol Carrie Underwood in 2005, and in 2006, Birmingham native Taylor Hicks became the American Idol. Hicks put his heart into his Idol audition and two judges voted for him.

The former Decatur Police officer charged with killing Steve Perkins wants a judge to halt all future court proceedings, including his upcoming immunity hearing and trial. Mac Bailey Marquette's lawyer filed that motion Friday. He wants a state appeals court to rule whether Marquette was using his legal discretion as a police officer, when he killed Perkins. Police initially said Perkins had a gun, and that Marquette shot him after ordering him to get on the ground.
