A Texas lawmaker is once again trying to repeal a state law criminalizing homosexuality, more than 20 years after the policy was ruled unconstitutional. State Rep. Venton Jones, D-Dallas, is continuing the decades-long pursuit with House Bill 1738. The law would repeal Section 21.06 of the Texas Penal Code, which states “deviate sexual intercourse with another individual of the same sex” is a criminal offense. It’s categorized as a Class C misdemeanor, carrying a fine up to $500 but no jail time.
