WHEELING – A former client has sued a suspended Wheeling attorney, accusing him of malicious prosecution after he filed a retaliatory civil lawsuit against her after she had filed an ethics complaint against him. Jolynn Mecca Gilchrist filed her complaint May 29 in Ohio Circuit Court against Paul J. Harris and Harris Law Offices.

CHARLESTON – The West Virginia Investment Management Board has passed a resolution to ban investments in companies owned or controlled by the Chinese Communist Party. The board voted May 29 on the resolution from Gov. Patrick Morrisey. The vote also lets the board begin a divestment plan from any currently owned investments in those companies.

CHARLESTON – The state Supreme Court has refused to reinstate the law license of a former Mingo County prosecuting attorney. In a 3-2 decision issued May 22, the Justices denied reinstatement for C. Michael Sparks, who was disbarred in 2013 after pleading guilty to a misdemeanor related to a political scandal. He resigned as prosecutor as part of a plea deal.

CHARLESTON – Two Charleston law firms are pursuing legal action against the manufacturers of ultra processed foods that are believed to be the sources of an epidemic of Type 2 Diabetes and Nonalcoholic Fatty Liver Disease in Mountain State children. HUNTINGTON – A former director at the Huntington City Mission claims she was a victim of age and gender discrimination. Amy Dial filed her complaint last month in Cabell Circuit Court against The Huntington City Mission Inc. According to the complaint, Dial worked for the mission for more than 23 years. She was its director of operations when she was fired January 4, 2024, and replaced with a substantially male employee. At the time, she says she over 40 years old.

CHARLESTON – Dan Greear is seeking re-election to the state Intermediate Court of Appeals. Greear, who was the first chief judge of the court, was appointed to the court for a four-year term by former Gov. Jim Justice when it was created in 2021. He served as chief judge from the court’s opening on July 1, 2022, through the end of 2023. “West Virginians deserve fair courts and honest judges,” Greear said.

CHARLESTON – A class action lawsuit claims doctors at Charleston Area Medical Center performed “unnecessary and invasive” hernia surgeries on patients. The complaint, which originally was filed April 23, says the hernia surgeries were performed during bariatric surgeries and that the defendants failed to obtain informed consent from the plaintiffs. In fact, the complaint says the defendants concealed that these procedures were performed.

CHARLESTON – Two parents have sued West Virginia state health officials to stop state education officials from enforcing Gov. Patrick Morrisey’s executive order regarding religious exemptions for vaccines. Marisa Jackson and Dr. Joshua A. Hess filed the complaint May 23 in Kanawha Circuit Court against the West Virginia Department of Health, West Virginia Bureau for Public Health, interim Commissioner for Public Health Justin Davis and Department of Health Secretary Arvin Singh.

CHARLESTON – A partner in a high-profile Charleston law firm claims the other partner ghosted him. Michael O. Callaghan filed his complaint May 7 in Kanawha Circuit Court on behalf of himself and his law firm Neely & Callaghan against Charles W. Neely. Charles “Chase” Neely is the son of the late Richard Neely, a former state Supreme Court justice. Callaghan is a former federal prosecuting attorney. He and Richard Neely created the firm in 2007.
