(This story has been updated to add new information.)A jury has reached a split verdict in the case of three defendants who went to trial in the 21-defendant Hertel & Brown federal health care fraud case. After deliberating about 11½ hours over two days, a jury of nine men and three women on April 23 acquitted two of the defendants, Abigayle J. Fachetti and Marissa S. Hull, of all charges against them — the felonies of health care fraud and conspiracy to commit wire fraud and health care fraud.

An ill juror put the Hertel & Brown trial on hold for a day in federal court in Erie. U.S. District Judge Robert Colville sent all the jurors home on Monday morning to give the sick juror time to recover and return on Tuesday. No testimony was presented. The ill juror never arrived at the federal courthouse on Perry Square on Monday morning after he became sick while driving in, Colville and his staff said in court.

The U.S. Attorney's Office is using evidence from physical therapy education to prosecute the remaining defendants in the Hertel & Brown Physical & Aquatic Therapy fraud case. The prosecution is arguing that the defendants should have known their actions were illegal based on their professional training. Witnesses testified that they were aware of the improper billing practices but continued to participate due to pressure from superiors.
