The New York State Dept. of Transportation is not appealing a court order requiring the department to conduct an Environmental Impact Statement for its $1.5-billion project to cap a portion of the Kensington Expressway in Buffalo, N.Y.The state supreme court ordered on March 12 that NYSDOT conduct an EIS before advancing the highway redevelopment plan.
