Douglas Carter appeared in court this afternoon in the first step of what could potentially be a retrial of the 1985 murder of Eva Olesen. On Tuesday, Judge Derek Pullen found Carter indigent, meaning he cannot pay for his own attorney, since he has been in prison for 40 years. He appointed the Utah County Public Defenders Association (UCPDA) to represent him.

SALT LAKE CITY (KUTV) — A hearing has been scheduled in the possible retrial of a man who was convicted of murder and has been on death row for 40 years. Douglas Carter’s conviction for aggravated murder and death sentence were tossed out by the Utah Supreme Court last month. The case was sent back to the district court for a retrial. Utah County Attorney’s office confirmed to KUTV it plans to retry Carter. A spokesman said the office is “meticulously reviewing the evidence in the case.
